1. Agreement to Terms

By accessing or using JobFit ("Platform"), operated at tryjobfit.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and JobFit. We reserve the right to modify these Terms at any time, and changes will be effective upon posting. Your continued use of the Platform after modifications constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 16 years old to use this Platform. By using the Platform, you represent that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

  • You may register using Google OAuth or other available authentication methods
  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Platform Services

JobFit provides the following services:

  • Job Search & Matching: AI-powered job matching based on your profile and preferences
  • LMIA Job Tracking: Listing and tracking of Labour Market Impact Assessment approved positions
  • AI Cover Letters: AI-generated cover letters tailored to specific job applications
  • Salary Explorer: Salary data and insights for various positions in Canada
  • Job Alerts: Customizable email notifications for new job postings
  • Employer Services: Job posting, candidate management, and application tracking
  • Career Resources: Blog articles and career guidance content

5. User Conduct

When using our Platform, you agree NOT to:

  • Post false, misleading, or fraudulent job listings or profile information
  • Use the Platform for any illegal or unauthorized purpose
  • Harass, abuse, or harm other users of the Platform
  • Scrape, crawl, or use automated tools to extract data from the Platform
  • Attempt to gain unauthorized access to the Platform or its systems
  • Upload viruses, malware, or other harmful code
  • Impersonate another person or entity
  • Use the Platform to distribute spam or unsolicited communications
  • Circumvent or disable any security features of the Platform
  • Reproduce, duplicate, or sell any part of the Platform without permission

6. AI-Generated Content

Our Platform uses artificial intelligence to generate content such as cover letters, job match scores, and career recommendations. Regarding AI-generated content:

  • AI-generated content is provided as a starting point and should be reviewed before use
  • We do not guarantee the accuracy or suitability of AI-generated content
  • You are responsible for reviewing and editing AI-generated content before submission
  • You retain ownership of AI-generated content created for your use
  • We are not liable for any consequences resulting from the use of AI-generated content

7. Employer Terms

If you use the Platform as an employer, you additionally agree to:

  • Post only genuine, current job openings
  • Provide accurate company and job description information
  • Comply with all applicable employment and labor laws
  • Not discriminate against candidates based on protected characteristics
  • Respond to applications in a timely and respectful manner
  • Not use candidate data for purposes other than recruitment

8. Intellectual Property

The Platform, including its design, logos, text, graphics, software, and all other content, is the property of JobFit and is protected by copyright, trademark, and other intellectual property laws.

  • You may not copy, modify, or distribute our content without prior written consent
  • The "JobFit" name, logo, and branding are our trademarks
  • You retain ownership of content you upload (resume, profile information)
  • By uploading content, you grant us a license to use it for providing our services

9. Third-Party Links and Services

Our Platform may contain links to third-party websites and services, including external job postings and employer websites. We are not responsible for the content, privacy practices, or availability of third-party sites. Accessing third-party links is at your own risk.

10. Disclaimers

  • The Platform is provided "as is" and "as available" without warranties of any kind
  • We do not guarantee that job listings are accurate, current, or complete
  • We do not guarantee employment outcomes or job placement
  • We are not an employment agency or staffing firm
  • LMIA information is provided for reference only and may not reflect real-time status
  • AI-generated recommendations are not a substitute for professional career advice
  • We do not verify the identity or credentials of employers or candidates

11. Limitation of Liability

To the maximum extent permitted by law, JobFit and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, resulting from your use of or inability to use the Platform.

In no event shall our total liability exceed the greater of CAD $100 or the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless JobFit, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. You may also delete your account at any time. Upon termination, your right to use the Platform ceases immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Montreal, Quebec, Canada.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
